China is taking benefit while it is facing unprecedented chances and challenges since it entered the WTO, especially the green trade barriers with strict environmental standards and other environmental requirements. Lots of products from China are hardly to expand the international market because of green trade barriers. Green barriers, naturally, will have a profound impact on the development of China’s economy, since it has become one of barriers in the preceding of the development of China’s export. It is inevitable for us to establish legal system on the green trade barriers that is based on the trend of development of international trade. It is fundamental, therefore, for us to study the impact on development of China’s export from green trade barriers and the countermeasures.First and foremost, the author theoretically researches the green trade barriers, induces and summarizes current status at home and abroad, elaborates the conception and pattern, and analyzes its features. The author also discuss positive and negative effects ,which are preparation for discussing the defects and its origin from the aspect of China’s current legal system ,of green trade barriers to China’s exports.What’s more, the author puts forward that, on the basis of a comprehensive investigation and analysis about current green trade barriers legal system, the origin of this negative effect is that there has been some defects characterized as “lack of Green-oriented” in current green trade barrier legal system, consequently our green trade barrier doesn’t work as a guarantee to ensure that our export products are fit for international general standards. The expressions of “lack of Green-oriented” defects in China’s current legal system on green trade barriers are the clash and impracticability of current legal system, the imperfection of international cooperation mechanism, and the unavailability of management. The author points out that China’s current legal system on green trade barriers no longer matches the need for the development of international trade. Thus, it is essential for author to put forward the raising suggestions in next part for legal defects in China green trade barriers system. Last but not least, the author raises that it is imperatively for us, oriented by current export policy, to establish coordinated and united legal system and management mechanism that is matched with green trade barriers, to revise context of current laws that is uncoordinated with green barriers, to strengthen international cooperation so that we can establish and utilize reasonable roles and only in this way can we improve and perfect China’s legal system on green trade barriers.The author points out that it is dialectically for us to research and utilize green trade barriers and improve China’s legal system, this is the core of this thesis. It is inevitable that green trade barriers will exist in international for a long period. We, therefore, should analyze and recognize its nature, realize its due character, give full play to its positive effects and avoid its negative effects.
